Wioks Global, S. L. (hereinafter, "we", "us" or "PidoHoy") is firmly committed to protecting the personal data of all users of our website, PidoHoy.com and our mobile applications (collectively, the "Pages"). We recommend that you read this data protection policy, in which we explain how we obtain and protect information about you. For this purpose, PidoHoy is the "controller" of the data we collect about you.

How we obtain your data 

We collect personal information about you each time you interact with us or use or provide services to us; for example, when you use our Pages to place an order. We also monitor how users use our Pages so that we can improve our services and your customer experience. 

We get information: 

  • when you create an account with us or every time you change your account settings; 
  • when you place an order with us, as well as during the entire service process of your order (including payment and delivery); 
  • when you contact us directly by email, phone, letter, message or through our chat function; and 
  • every time you browse and use one of our Pages (both before and after you create an account with us). 

We also obtain information from third party websites, such as advertising platforms [and our fraud detection service provider].

Data we obtain from you 

As part of our commitment to protecting the data of our customers and, more generally, those who visit our Pages, we want to be transparent about the types of data we will obtain about you. 

Each time you visit the Pages or place an order with PidoHoy through them, you are asked to provide us with certain information about yourself, including full name, contact information, delivery address, order details and payment information such as your credit or debit card details. 

We also obtain information about your use of the Pages (please visit our Cookie Policy for more information), as well as information about you from messages you send through the Pages, or whenever you contact us or make comments; this includes email, mail, phone calls or the chat function. If you contact us by telephone, we record the call for the purposes of training and improving our services, as well as taking notes in relation to your call.

We collect technical information about your computer or mobile device, such as your operating system, device type and connection, or the IP address from which you access our Pages. 

In addition, PidoHoy obtains technical information regarding your use of our services through mobile devices; for example, telephone company, location data and operating data, such as mobile payment modes, interaction with other sales technologies, such as use of NFC tags, QR codes and/or use of mobile vouchers. Unless you have chosen to remain anonymous through the configuration of your device and/or platform, we may obtain this information and use it automatically whenever you use our services through mobile devices using any PidoHoy mobile application, through your mobile browser or otherwise. 

We only process data relating to your health when you indicate your acceptance and willingness to do so, for example, if you specify allergies to certain foods.

Use of your data 

We will only process the data we obtain about you if there is a reason for it and if that reason is covered by data protection legislation. We will be entitled to process your information in the following cases: if we need to process data about you in order to provide you with the requested service or to sign a contract; if we have your consent; if we have a justified reason for processing your data; or if we are obliged to do so by law. 

Where we need it to provide you with the services you have requested or to sign a contract, we use your information:

  • so that we can give you access to the relevant sections of the Pages; 
  • to provide you with the requested services;
  • so that we can collect from you; and 
  • to contact you whenever necessary in relation to our services, for example, to resolve problems that may arise with your order.

We also process data about you if we have a justified reason to do so, for example, to personalise our service, which includes processing data to facilitate and speed up the order process. These are, in more detail, the justified reasons we talk about:

  • to improve the effectiveness and quality of service that our clients can expect from PidoHoy in the future; 
  • to customize the content that we or our restaurant and business partners or advertising partners present to you, such as showing you which restaurants or businesses are in your area or ensuring that you see the ads that best suit your tastes, based on the features that we pre-determine; 
  • so that our customer service department can help you with any questions or complaints in the most efficient way possible; 
  • to contact you with your impressions and feedback about our services, and to notify you of any important changes or developments to the Pages or our services, including informing you that our services are operational in a new area if you have requested it; 
  • to analyse your activity on the Pages, in order to manage, support, improve and develop our business; also, for statistical and analytical purposes and to help us prevent fraudulent behaviour;
  • to comply with and enforce the contractual terms between you and PidoHoy, and any other agreement or contract, as well as to take legal action or defend ourselves against them, and to protect the rights of PidoHoy, our associated restaurants and businesses and other persons (including fraud prevention); 
  • to enable us to carry out corporate transactions, such as mergers, sales, reorganisations, transfers of assets or business, acquisitions, bankruptcy proceedings or similar events; 
  • if you submit comments and feedback regarding the Pages and our services, we may use them on the Pages and in any marketing and advertising activities or materials. In these cases, we will only indicate your name and the city in which you reside; and
  • If you have agreed to receive notifications from us through our mobile application, we may send you notifications regarding the services you have requested and information about our services and offers. You can stop receiving notifications at any time by changing your preferences in your mobile device settings.

We will also analyse information about your use of our services based on your location data, in order to create profiles related to you and for you on the basis of that data. This means that we may make certain assumptions about what is of interest to you and, based on these assumptions, send you, for example, more personalised marketing communications, let you know about restaurants and businesses that we think may be of interest to you or send you special offers or products that we think you might prefer. This activity is known as "targeting or profiling". In relation to this type of processing of your data, you have certain rights; we refer you to the 'Your rights' section if you want to know more about it. 

Where we have a justified reason for processing your personal data, we carry out a check to ensure that the processing is necessary and that your fundamental rights to privacy protection are not overridden by such justified reasons. Where we are required by law to do so, we may use your information to:

  • create a record of your orders; and
  • to comply with all legal and regulatory obligations to which we are subject.

Disclosure of your data 

The information we collect about you will be transferred to and stored on our servers. We act with full responsibility and transparency about with whom else we share this information. 

Internal data exchange:

  • We exchange information with other companies of the PidoHoy group only when necessary. 

Exchange of data with third parties:

We exchange data about you with third party service providers. These are the types of third party service providers with whom we share information about you: 

  • Payment service providers (including online payment service providers and fraud detection services): so that they can provide their services to us, for example, when they process information such as credit card payments, when they provide support services directly to you or when they do fraud background checks for us;
  • IT service providers (including cloud service providers) for data storage and analysis
  • Associated shops: those partners and businesses to which you place the order, so that they can follow up on the order, find out about food allergies that you agree to make known, solve problems or improve their services; 
  • Deliverers: so that they can deliver your order;
  • Third party partners for customer services: who will help us solve any problems that may arise with our services; and 
  • Third party marketing and advertising partners: to ensure that you receive the advertising that interests you most and to send you electronic marketing on behalf of PidoHoy. 

PidoHoy will take all necessary steps to ensure that your data is processed safely and in accordance with this policy, in cases where it is transferred to third parties. 

If our company enters into a joint venture, acquires or is sold, or merges with another company, we may transfer or disclose information about you to that company, our new business partners or owners and/or their advisors.

We will also be able to share your information: 

  • whether there is an obligation for Pidotoday to disclose or share your information in order to comply with (and/or if we believe it is our obligation to comply with) legal or regulatory requirements. This includes where we are legally obliged to respond to requests for information from the police or to exchange information with other companies or organisations for the purpose of preventing and/or protecting against fraudulent behaviour; 
  • in order to fulfil and enforce the contractual conditions signed with you and any other contract; 
  • to protect the rights of PidoHoy, our partners and associated businesses, and others, including fraud prevention; and 
  • with other third parties where, in our opinion, this is reasonably necessary to detect or prevent the commission of crimes, for example with the police.

International data transfers: 

  • In some cases, the personal data we obtain about you may be processed outside the European Economic Area ("EEA"), such as in the United States, Andorra and those countries where PidoHoy operates. These countries may not provide the same level of protection for your personal data as the protection they enjoy in the EEA countries. In any case, we at PidoHoy are obliged to guarantee that the data processed by us and our suppliers outside the EEA has the same level of protection as it would have if it were processed within the EEA. Therefore, there are a number of guarantees when your data is processed outside the EEA. 

We will do our best to ensure that the same level of protection is provided by ensuring that at least one of the following protective measures is applied:

  1. that your personal data is transferred to countries which, in the opinion of the European Commission, offer an adequate level of protection for personal data; 
  2. that we use the standard contract terms approved by the European Union; and 
  3. that if your personal data are transferred to third party providers established in the US, it is possible to transfer data to them if they have self-certification under the Privacy Shield framework for the type of data being transferred, for which these third parties must provide an equal level of protection between the EU and the US.

I. PRIVACY POLICY 

In compliance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and with Organic Law 3/2018 of 5 December on the protection of personal data and the guarantee of digital rights, you are hereby informed that the personal data provided by you through the pidohoy.com website (hereinafter the website) will be processed in the following terms: 

Purposes of treatment

  • To inform you about our products and services, when you request it through the forms on the website or by e-mail. 
  • To answer and manage your queries, comments and suggestions, where appropriate. 
  • To manage your participation in present and future selection processes, when you send us your data (including your curriculum) for that purpose. 
  • In order to obtain information on the use of the website, the number of pages visited, the number of visits, as well as the activity of the visitors and their frequency of use are analysed. To this end, the LIABILITY PERSONNEL uses statistical information prepared by the Internet Service Provider that does not allow the interested party to be identified at any time.

Legitimation 

Consent. The personal data obtained through the forms on the website will be processed only on the basis of the consent given by the interested party, through the acceptance of the box provided for this purpose. This consent can be withdrawn at any time. 

Legitimate interest of the person in charge. The statistical information obtained from the website will be processed on the basis of the legitimate interest of the person responsible. This information does not allow the user to be identified. 

Target group 

Personal data obtained through the website will not be communicated to third parties, unless legally required to do so. 

Conservation

The personal data provided by the user to receive commercial communications will be kept as long as the interested party does not request their deletion or withdraw their consent. 

When the user sends his personal data to participate in selection processes of the person in charge, the data will be processed to participate in these selection processes, and if he is not selected, his personal data will be kept for a period of two years in order to be able to count on his participation in future processes. 

When the user sends his/her data to contact the person in charge, make queries or suggestions, the data will be kept for as long as it is necessary for this purpose and responsibilities may arise from the processing. Traffic data, statistics and web visits: the data will be kept for a period of three years.

Rights 

You may exercise your rights to access, rectify, delete and transfer your data, and to limit and oppose its processing, by writing to PidoHoy, accompanied by an official document identifying you, using the contact details in the heading. If you disagree with the processing, you also have the right to file a complaint with the Spanish Data Protection Agency (www.aepd.es). 

Policy on the protection of minors 

Whoever provides the data through the forms on this website and accepts its treatment formally declares to be over 14 years old. 

Access to and use of the portal is forbidden to children under 14 years of age. 

The person in charge reminds adults who are responsible for minors that it will be their sole responsibility if a minor enters their details to order a product. 

It also informs them that there are computer programs to limit navigation by filtering or blocking certain content.

Treatment derived from the use of social networks 

By following our profile on social networks you expressly consent to the processing of your personal data in accordance with the privacy policy of the relevant social network. Likewise, you expressly consent to the processing of your data contained in your profile by the person responsible and that news published about any product of the person responsible appears on his wall. Your request to connect necessarily implies your consent to the aforementioned processing, this being the legal basis of the processing. 

The data will be kept as long as the interested party does not request their opposition or withdraw their consent, and they may withdraw their consent at any time. Comments and content published on social networks will become public information, so users should be especially careful when deciding to share their personal information. The person in charge is not responsible for the information that users incorporate into the page. However, persons whose personal data are published or included in comments may request the person responsible to cancel these.
